Sale and Purchase of Goods

Mybakeguru, referred to as “bakeguru” hereafter (“Seller”) consents to sell, and You (“Buyer”) accept to purchase, products with the description and amount defined on the checkout window (“Checkout”) and included in this Agreement by this reference (“Goods”) on the conditions and terms stated in this Agreement.

Purchase Price

The buyer acknowledges they must pay the Purchase Price of the goods published on bakeguru’s website.

Payment Terms

The full amount of the purchase price needs to be paid off by Buyer according to the payment due date mentioned on Checkout. Moreover, bakeguru can assert any remedies they are permitted to pursue legally and will be reimbursed for all associated costs, including lawyer fees, legal fees, and any additional expenses.

Delivery

Unless otherwise agreed on in writing, delivery will take place in accordance with the delivery policy applied by Bakeguru on the date designated for shipment. Dates declared by Bakeguru are merely estimations. Bakeguru will strive to deliver as stated by these dates but is not legally responsible for failures in delivery. Unless otherwise decided in writing by Bakeguru, the Goods are to be packaged according to the standards and procedures of Bakeguru.

Customs, Duties, and Taxes

The recipient is responsible for ensuring that products ordered from www.bakeguru.co.in can be legally imported to the destination country. Orders sent to countries other than India may be subject to import taxes, customs duties and fees imposed by the destination country. Recipients of international shipments can be subject to such custom taxes, duties and fees which are charged once a shipment reaches the destination. Any additional expenses for customs clearance must be borne by the recipient, and unfortunately, we have no control over or knowledge of playing what these charges may be. Customs policies vary from country to country so the recipient should contact their local customs office for further information. Delays in delivery times due to customs clearance may occur. The carrier could collect Customs, duties and taxes, or Octroi charges, from the recipient after paying it to the local customs office on the recipient’s behalf. The recipient may need to provide a social security number, tax ID, evidence of address or proof of business, depending on what their customs office requires in order to have the shipment cleared.

Disclaimer of Warranty/Limitation of Liability

Bakeguru holds no accountability for the quality of the Goods given or that the Goods will be compatible with any particular purpose for which Buyer may be purchasing the Goods, but for any exceptions stated in this Agreement, Bakeguru disclaims all other warranties and conditions, direct or implied. In any case, Bakeguru (including its subsidiaries, associates, officers, directors, employees, intermediaries or subcontractors, which are all collectively referred to herein as the “Bakeguru Affiliates”) shall not be obligated to Buyer or any other individual for any special, consequential, casual or exemplary punishment due to being related or connected whatsoever to the Goods or otherwise, comprising but not limited to damages for lost gains, loss of the Goods or any accompanying equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, downtime, Buyer’s time, lost information, injury to properties or any damages or payments paid by the Buyer to third-parties, even if Bakeguru or any of the Bakeguru Affiliates has been advised of the possiblity of such damages. Color Disclaimer

The colors of items you view on your computer or phone may not exactly match the colours of the actual products due to the contrasting properties of digital screens and fabric. If the monitors are not calibrated properly, this may further contribute to the discrepancies in hues. The lighting used when taking photographs may also affect the shade that appears on-screen, thus causing a slight variation in shades.

Force Majeure

Bakeguru shall not be held responsible for any inability to fulfill their obligations to deliver the Goods on time if such failure was due, in whole or in part, to action taken by a government body, act, ordinance, regulation, strike or other labor dispute, a fire that impacted the Goods or the facility where they were made, an inability to get raw materials or labor, fuel, electrical power, water or supplies, or any other force majeure event not within the reasonable control of Bakeguru. Bakeguru shall make a good faith effort to determine what actions and measures can be taken to limit or remove the impact of such an event.

General

The buyer cannot assign this Agreement without the written consent of the Bakeguru. Bakeguru is the only beneficiary of this Agreement and if there is any inconsistency between this Agreement and any other agreement linked to or regarding the Goods, this Agreement shall take precedence. Without the written consent of Bakeguru, this Agreement cannot be modified, altered or amended. All additional or substituted terms finished to any order issued by the buyer shall be void, unless agreed to in writing by Bakeguru. The legality and enforceability of the remaining stipulations shall not be affected or impaired, even if any term of this Agreement is illegal or unenforceable. This Agreement is to be interpreted in terms of the laws of Karnataka, INDIA without consideration for laws of conflicting. If there is a dispute under this Agreement then the exclusive jurisdiction and venue lies in the jurisdiction of Jayanagar, Bangalore, Karnataka, and hereby the buyer waives any challenge to such jurisdiction and venue..
